The house we are buying backs onto a reserve. The pool encroaches onto the reserve and so does some of the back garden. It has been like this for many years and has passed from proprietor to proprietor. There have been 2 Council building inspections since the pool was installed as the house has been extended but no one has mentioned the encroachment. The solicitor says worse case scenario is the council could reclaim the land... although I have read that after a substantial amount of time has passed it would prove difficult for them to do so. Any comments from anyone who has experience of this appreciated. NSW resident. Thanks.
