Hi, recently selling investment in Brisbane, Buyer had 21 days finance clause and terminated on Clause 3 after 15 days. After communication and learning they had attended the property without notice, i do not believe the finance clause was used as intended. I do not believe they had tried to obtain Finance from a Financier and on request of a bank letter to show they had made reasonable steps to obtain Finance their solicitor has come back to say there is nothing in Clause 3 to say evidence is required. As a seller is there any recourse and does the Buyer have an obligation to show they have taken all 'reasonable steps' to obtain Finance under REIQ sales Contract.
