Developer refused to fix unfinished work on settlement

We bought our OTP apartment two years ago and it was due to settle recently. Few days before settlement we were given a chance to inspect the apartment. We then found the balcony flooring had no tiles although it's clearly stated in the sales contract it's tiles flooring for balcony. As advised by our solicitor we should asked to delay the settlement till we receive an answer from developer. Few days past, our solicitor had emailed vendor solicitor couple of times highlighted the issues but no reply heard. However we heard from the company where we bought the apartment that developer refused to fix it with the some excuses. We are now being pressured to settle or risk having the contract rescinded (return of our 10% deposit).
We called Fair trading and understand that we can lodge a complaint however this is very time consuming and would be costly too.
Does anyone had any other advice to share?

    How did you go with this? Did the developer end up sticking to their word?
